These Terms and Conditions (“Terms”) govern your access to and use of the Fortune Cloud platform, website, and related services (collectively, the “Service”) provided by Fortune Cloud (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
Please also read our Privacy Policy, which explains how we collect, use, and process your personal data.
You must be at least 18 years old or the age of majority in your jurisdiction, whichever is higher, to use the Service. By agreeing to these Terms, you represent and warrant that: (a) you meet the age requirements; (b) you have not previously been suspended or removed from the Service; and (c) your use of the Service complies with all applicable laws.
To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep it up to date. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. If you suspect unauthorized access, you must notify us immediately at hello@fortunecloud.co.
You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, or impair the Service. Specifically, you may not:
FORTUNE CLOUD WILL NOT USE YOUR INPUTS OR OUTPUTS TO TRAIN, OR ALLOW ANY THIRD PARTY TO TRAIN, ANY AI MODELS, UNLESS YOU HAVE EXPLICITLY OPTED IN TO SUCH USE.
Outputs are generated automatically by AI technology and may contain errors, inaccuracies, or misleading information. AI-generated destiny reports based on Zi Wei Dou Shu and Ba Zi are for informational and entertainment purposes only. They do not constitute professional advice of any kind. You agree that you are solely responsible for how you interpret and act upon any Outputs, and that you bear all risks associated with reliance on such Outputs.
You are solely responsible for any decisions you make based on the Service's Outputs. Fortune Cloud is not responsible for any consequences arising from your reliance on AI-generated destiny reports.
You retain all ownership rights in your Inputs. By submitting Inputs to the Service, you grant Fortune Cloud a worldwide, non-exclusive, royalty-free license to use, process, store, and display your Inputs solely to provide and improve the Service (excluding AI model training, as set out in Section 6.1).
Fortune Cloud assigns to you all rights, title, and interest in Outputs generated specifically for you. Due to the nature of AI, similar or identical Outputs may be generated for other users. No rights to Outputs generated for other users are granted to you.
Fortune Cloud retains all ownership rights in the Service, including all software, algorithms, trademarks, and other intellectual property. No rights are granted to you except as expressly stated in these Terms.
If you provide feedback, suggestions, or ideas about the Service (“Feedback”), you grant Fortune Cloud an unrestricted, perpetual, irrevocable license to use such Feedback for any purpose without compensation or attribution.
The Service offers one-time purchases for destiny reports. By purchasing a report, you authorize us to charge your designated payment method for the applicable fee plus applicable taxes.
Due to the nature of AI-generated content, all sales are final once a report has been generated. If you experience a technical issue that prevents report delivery, please contact us at hello@fortunecloud.co.
We may change pricing at any time. Price changes will not affect purchases already completed.
The Service integrates with third-party services, including payment processors (such as Stripe), cloud infrastructure providers, and AI model providers. Your use of third-party services is governed by their respective terms and policies. Fortune Cloud is not responsible for the actions, content, or policies of any third-party service.
You may stop using the Service at any time. We reserve the right to suspend or terminate your access at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service immediately ceases and we may delete your account and associated data in accordance with our Privacy Policy. Provisions regarding intellectual property, payment obligations, indemnification, disclaimers, and limitation of liability will survive termination.
THE SERVICE AND ALL OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT AI-GENERATED OUTPUTS ARE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PURPOSE. DESTINY REPORTS ARE FOR INFORMATIONAL AND ENTERTAINMENT PURPOSES ONLY AND DO NOT CONSTITUTE PROFESSIONAL, FINANCIAL, MEDICAL, OR LEGAL ADVICE. YOU AGREE THAT ANY USE OF OUTPUTS IS AT YOUR SOLE RISK.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORTUNE CLOUD AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO FORTUNE CLOUD FOR THE SERVICE IN THE 6 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.
You agree to defend, indemnify, and hold harmless Fortune Cloud and its affiliates, officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party right, including intellectual property rights.
These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region.
Before filing any claim in court, the parties agree to attempt in good faith to resolve any dispute informally by contacting the other party. If the dispute cannot be resolved within 30 days, either party may pursue formal legal remedies.
We may modify these Terms at any time. If we make material changes, we will notify you by updating the date at the top of these Terms and, where appropriate, by providing additional notice. Your continued use of the Service after such changes constitutes acceptance of the revised Terms. If you do not agree, you must discontinue using the Service.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Fortune Cloud shall not be liable for any failure or delay in performing our obligations where such failure or delay results from causes beyond our reasonable control, including natural disasters, war, government actions, failures of telecommunications or internet service providers, or failures of third-party services including AI providers.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fortune Cloud concerning the Service and supersede all prior agreements or understandings.
No waiver of any term or condition shall be deemed a further or continuing waiver of such term or any other term. Any failure of Fortune Cloud to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. Fortune Cloud may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of all or substantially all of our assets. Any attempted assignment in violation of this section is void.
Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and Fortune Cloud.
